Monitoring and enforcement

Monitoring

The OfS will take a risk-based approach to regulating in this area.

This means that we focus regulatory attention on those providers that are at greatest risk of breaching their conditions of registration.

To identify risk we look at:

  • Indicators constructed for all providers from routine data collections.
  • Reportable events submitted by a provider.
  • Any additional information that we have asked the provider to submit to the OfS.
  • Notifications about an individual provider from third parties, such as students and their representatives or whistle-blowers.

Intervention

Where there is intelligence or evidence which suggests compliance concerns for a provider, the OfS may:

  • engage with the provider to make sure it is aware of the issues
  • gather further information
  • use its investigatory powers.

Enforcement

If the OfS decides that there has been a breach of this condition, it could lead to:

  • additional reporting requirements for the provider
  • imposition of further regulatory requirements through a specific condition of registration, details of which we would expect to publish
  • imposition of a monetary penalty
  • suspension of elements of a provider’s registration (for example, its access to student support funding or OfS public grant funding).
